General Terms and Conditions
This is an English translation provided for information. The contract is concluded in Hungarian, and in case of any discrepancy the Hungarian version is legally binding.
These General Terms and Conditions (hereinafter: GTC) set out the rights and obligations of SpicaHome Kft. as the service provider and of the Customer using its services. Please read them carefully before placing your order. By placing an order, you accept the terms set out here.
1. Details of the Service Provider
Name: SpicaHome Korlátolt Felelősségű Társaság (limited liability company) · Registered office and postal address: 2092 Budakeszi, Jegenye utca 1., Hungary · Company registration number: 13-09-248984, registered by the Court of Registration of the Budapest Environs Regional Court (Budapest Környéki Törvényszék Cégbírósága) · Tax number: 33116602-2-13 · EU VAT number: HU33116602 · Represented by: Pongrátz Anita, managing director · Email: info@spicahome.com · Phone: +36 30 214 0000 · Bank account: 10410400-00000190-30686157 (Kereskedelmi és Hitelbank). The details of the hosting provider can be found in the legal notice.
2. Scope, acceptance and amendment of the GTC
The GTC apply to all services and orders available on the spicahome.com website (hereinafter: Website). The GTC are effective from 13 September 2026 and remain in force until withdrawn or amended.
Before placing an order, the Customer accepts the GTC by an express declaration, made by ticking the checkbox provided for this purpose. Without this acceptance, the order cannot be placed.
The Service Provider is entitled to amend the GTC unilaterally. Amendments take effect upon publication on the Website and do not affect orders already placed: such orders are in all cases governed by the provisions of the GTC in force at the time the order was placed. The Service Provider archives previous versions.
3. Definitions
Consumer: a natural person acting outside the scope of their profession, independent occupation or business activity. Business: a person acting within the scope of their profession, independent occupation or business activity. Customer: a Consumer or Business placing an order on the Website. Where these GTC expressly refer to a Consumer, the provision in question applies exclusively to Customers who qualify as Consumers.
4. Range of products available for purchase
The Website offers SpicaHome gift, home décor and art products, including products that qualify as food (gingerbread), textile and paper accessories, placemats and limited-edition art prints.
The essential properties, composition and characteristics of the products are set out on the individual product pages. Product photos are illustrations; owing to the nature of handmade production, slight variations in the shade, pattern and size of the products may occur, and these do not constitute defective performance.
For limited-edition prints, the Service Provider states the total number of copies in the series on the product page. Once the edition has sold out, the product can no longer be ordered.
5. Prices and shipping fee
Prices shown on the Website are in Hungarian forints and include VAT. Prices do not include the shipping cost, which is shown separately on the order summary page before the order is finalised.
Within Hungary, the shipping fee depends on the delivery method: to a parcel locker HUF 1,190 (≈ €3.33), free for orders over HUF 15,000 (≈ €42.00); home delivery HUF 2,790 (≈ €7.81), free for orders over HUF 30,000 (≈ €84.00). No shipping fee is charged for personal collection. For delivery to Austria and Germany (GLS home delivery), the shipping fee is HUF 7,990 (≈ €22.37) per order, or HUF 12,990 (≈ €36.37) if the order contains the Advent package; no free-shipping threshold applies to these deliveries. For delivery to other Member States of the European Union, we will inform you of the fee in an individual confirmation before the order is placed.
The Service Provider reserves the right to change prices. Changes take effect upon appearing on the Website and do not affect orders already confirmed.
If an incorrect price is displayed due to an obvious error – in particular a price that differs significantly from the commonly known, generally accepted price of the product, or a zero or token price shown because of a system error – the Service Provider is not obliged to sell the product at the incorrect price. In such a case, the Service Provider will inform the Customer without delay after discovering the error, and the Customer may decide to place the order at the correct price or withdraw from the purchase. The Service Provider regards a contract concluded at an incorrect price as null and void.
6. Ordering process
The Customer places the selected product in the basket in the desired quantity. The contents of the basket can be viewed and changed at any time. The Customer then enters the billing and delivery details, selects the delivery and payment method, and on the summary page checks the full content of the order: the products, the quantity, the total amount payable and the shipping fee.
Input errors can be corrected at any time before the order is submitted by editing the basket and the data fields, or by using the back button. If the Customer notices an error after submitting the order, they may report it to the Service Provider's email address without delay, but no later than 24 hours after receiving the confirmation.
By clicking the “Order with obligation to pay” button, the Customer makes an offer that gives rise to an obligation to pay.
7. Conclusion of the contract
The Service Provider confirms receipt of the order by automatic email within 48 hours at the latest. This automatic confirmation acknowledges receipt of the order and does not constitute acceptance of the offer.
The contract is concluded when the Service Provider confirms, in a separate, substantive email, that the order can be fulfilled. If the automatic confirmation does not arrive within 48 hours, the Customer is released from being bound by their offer.
The contract is concluded in Hungarian, qualifies as a written contract and is filed by the Service Provider. The order details are retained for the period required by accounting regulations and can be accessed afterwards.
8. Payment terms
The price of the order can be paid by bank transfer to the Service Provider's following account:
Bank: Kereskedelmi és Hitelbank (K&H Bank Zrt.)
Account holder: SpicaHome Kft.
Account number: 10410400-00000190-30686157
IBAN: HU28 1041 0400 0000 0190 3068 6157
Payment reference: the order number given in your confirmation
For personal collection, the purchase price can also be paid in cash on site.
Online card payment is not currently available. If the Service Provider engages a payment service provider, it will state that provider's details in these GTC and in the privacy notice before the service is launched.
The Service Provider sends the payment details and the order number in the order confirmation. The product is dispatched once the payment has been credited to the bank account. If the transfer is not received within 8 calendar days of the confirmation, the Service Provider may cancel the order and will notify the Customer of this by email.
The Service Provider issues an electronic invoice for the fulfilment in the Számlázz.hu system (operated by KBOSS.hu Kft.) and sends it to the email address provided by the Customer. By placing the order, the Customer consents to the issuing and sending of the electronic invoice. The invoice is transmitted to the Online Számla system of the Hungarian Tax and Customs Administration (NAV) as required by law.
9. Delivery and receipt
Within Hungary, the Service Provider delivers orders, at the Customer's choice, via the parcel locker network of FoxPost Kft. (1097 Budapest, Könyves Kálmán körút 12-14.) or, for home delivery, via GLS General Logistics Systems Hungary Kft. (2351 Alsónémedi, GLS Európa u. 2.). Orders to Austria and Germany are delivered by GLS home delivery to the address specified by the Customer; FoxPost parcel locker delivery is available only within Hungary. In addition, personal collection in Budakeszi is possible by prior arrangement.
| Delivery method | Fee | Estimated time |
|---|---|---|
| FoxPost parcel locker (Hungary only) | HUF 1,190 (≈ €3.33) · free over HUF 15,000 (≈ €42.00) | 2–4 working days |
| GLS home delivery (Hungary) | Hungary: HUF 2,790 (≈ €7.81) · free over HUF 30,000 (≈ €84.00); Austria and Germany: HUF 7,990 (≈ €22.37) (HUF 12,990 (≈ €36.37) with the Advent package), no free-shipping threshold | 2–4 working days |
| Personal collection (Budakeszi) | free | by arrangement |
| GLS home delivery – Austria, Germany | HUF 7,990 (≈ €22.37) · with the Advent package HUF 12,990 (≈ €36.37) | 2–4 working days from dispatch |
The stated delivery time is counted from the date the purchase price is credited and applies to products in stock. For custom products or products currently in production, the applicable delivery time is stated on the product page; in such cases, the Service Provider will inform the Customer separately of the expected delivery date in the confirmation. Products currently offered for pre-order will be dispatched from early November 2026.
The Service Provider packs every shipment by hand. Fragile products – in particular art prints – are dispatched in a separate, reinforced shipping box.
Please inspect the parcel on receipt in the presence of the courier. If the packaging is damaged, ask for a damage report to be drawn up and do not accept the parcel. The Service Provider is unable to accept subsequent complaints about quantity or damage made without such a report – this does not affect the Customer's warranty rights.
If the shipment is not collected for reasons attributable to the Customer and is returned, the Service Provider may charge the cost of resending it. In the event of withdrawal, section 10 applies.
The risk of loss or damage passes to the Customer at the time the product is received.
10. Right of withdrawal and termination
Under Government Decree 45/2014. (II. 26.) Korm., the Consumer has the right to withdraw from the contract without giving any reason. The withdrawal period is fourteen days from the day on which the Consumer, or a third party other than the carrier designated by the Consumer, takes receipt of the product. Where several products are ordered, the period runs from the day on which the last product is received.
The Consumer may also exercise the right of withdrawal in the period between the day the contract is concluded and the day the product is received.
The right of withdrawal may be exercised using the model form in section 20 of these GTC, or by any other unequivocal statement to that effect, sent to info@spicahome.com or to the Service Provider's registered office. You can also withdraw electronically using the Withdraw from contract function of the online shop; the Service Provider immediately sends an e-mail confirmation. The withdrawal is deemed to have been exercised in time if the Consumer sends the statement before the withdrawal period expires. The burden of proving that the statement was sent lies with the Consumer.
In the event of withdrawal, the Consumer must return the product without delay and in any event no later than fourteen days from communicating the withdrawal. The direct cost of returning the product is borne by the Consumer. The Service Provider is unable to accept parcels sent cash on delivery.
The Service Provider will refund the full amount paid by the Consumer, including the cost of delivery, within fourteen days of becoming aware of the withdrawal. The refund is made using the same means of payment as the original transaction; a different means requires the Consumer's express consent. The Service Provider may withhold the refund until it has received the product back or until the Consumer has provided proof of having sent it back.
If the Consumer has expressly chosen a type of delivery other than the least expensive standard delivery, the Service Provider is not obliged to refund the additional costs arising from this.
The Consumer is liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
11. Exceptions to the right of withdrawal
The Consumer does not have the right of withdrawal in the cases set out in Section 29 of Government Decree 45/2014. (II. 26.) Korm. Within the SpicaHome range, this concerns the following:
- Perishable products or products that keep their quality for only a short time. This covers our freshly made foods with a short best-before period; we indicate this separately on every product page concerned.
- Sealed products that have been unsealed and cannot be returned after opening for health protection or hygiene reasons.
- Custom products made at the Consumer's request – such as prints made to individual commission, ribbons with personalised lettering and personalised gift packages.
- Products which, by their nature, become inseparably mixed with other items after delivery.
Important: we do not apply any automatic restriction on withdrawal to our durable, sealed gingerbread products and gift packages with a long best-before period. For these, the Consumer may exercise the right of withdrawal in accordance with section 10, provided the packaging is unopened. We believe that, with a gift, the buyer's trust is worth more than the few boxes that may be returned as a result of this decision.
On every product page concerned, the Service Provider indicates clearly and visibly, before the order is placed, if the right of withdrawal cannot be exercised, or can be exercised only to a limited extent, for that product.
12. Warranty for defects (kellékszavatosság)
In the event of defective performance, the Customer may assert a warranty claim for defects in accordance with the rules of the Hungarian Civil Code (Polgári Törvénykönyv). At the Customer's choice, they may request repair or replacement, unless fulfilling the chosen remedy is impossible or would cause the Service Provider disproportionate additional costs. If the Customer did not or could not request repair or replacement, they may request a proportionate reduction of the price, repair the defect themselves or have it repaired by a third party at the Service Provider's expense, or rescind the contract. Rescission is not permitted on account of a minor defect.
The Customer must notify the defect without delay after discovering it, and no later than within two months. The Consumer can no longer assert warranty rights for defects after the two-year limitation period counted from performance of the contract; for non-consumer contracts, this period is one year.
Within one year of performance, the only condition for asserting a warranty claim for defects, apart from notifying the defect, is that the Customer proves that the product was purchased from the Service Provider. After one year has passed, however, the Customer must prove that the defect already existed at the time of performance.
13. Product warranty (termékszavatosság)
If the product is defective, the Consumer may – at their choice, instead of a warranty claim for defects – also assert a product warranty claim against the manufacturer or distributor, that is, request repair or replacement of the product. The product is defective if it does not meet the quality requirements in force at the time it was placed on the market or does not have the properties stated in the description given by the manufacturer.
A product warranty claim may be asserted within two years of the product being placed on the market. The Consumer must prove that the defect exists. A warranty claim for defects and a product warranty claim may not be asserted simultaneously for the same defect.
The manufacturer is exempt from product warranty liability if it proves that it did not manufacture or place the product on the market in the course of its business activity; that the defect was not detectable according to the state of science and technology at the time the product was placed on the market; or that the defect results from the application of a legal provision or a mandatory official requirement.
14. Food information, ingredients and allergens
For products that qualify as food, the Service Provider publishes the mandatory information required by Regulation (EU) No 1169/2011 and the relevant Hungarian legislation on the product page, in a separate “Ingredients and allergens” section. This includes the name of the product, the list of ingredients in descending order of weight, the highlighted labelling of allergenic ingredients, the net weight, the best-before date, the storage conditions, the nutrition declaration, and the name and address of the food business operator.
The gingerbread products contain cereals containing gluten (rye, wheat) and eggs, and are made in a workshop where nuts, milk and soya are also used, so the presence of traces of these cannot be ruled out. If you have a food allergy, please check the data sheet of the specific product before purchasing.
Our food products are made in a registered Hungarian bakery that operates a HACCP system. The Service Provider's food producer identifier (FELIR): AA6364267.
The printed surfaces and the ribbons are not materials intended for direct contact with food; the product has been designed so that they do not come into contact with the food. The biscuit is in its own food-grade primary packaging, and the decorative ribbon runs outside it. Please observe this intended use.
15. Product safety (GPSR)
Under Regulation (EU) 2023/988 (General Product Safety Regulation), the Service Provider states on the product pages the name and contact details of the manufacturer or – where the manufacturer is established outside the Union – of the responsible person in the Union, the information enabling the product to be identified, and the warnings and safety information.
On our products intended for children, we state the age warning. Please follow the instructions for use and safety information supplied with the product.
If the Service Provider becomes aware that a product it sells is not safe, it will take the necessary measures without delay and provide information about this on the Website and – where their contact details are known – by notifying the affected buyers directly. Product safety reports can be made to info@spicahome.com.
16. Complaints and legal remedies
You can make a complaint orally by phone, or in writing by email or post, using the Service Provider's contact details above. We examine oral complaints immediately and remedy them where possible; if this is not possible, we draw up a record of the complaint. We reply to written complaints in writing and on the merits within thirty days of receipt and arrange for the reply to be sent. If we reject a complaint, we give the reasons for our position.
If the complaint procedure does not lead to a resolution, you may turn to the following bodies:
- Consumer protection authority: the Consumer Protection Department of the Pest County Government Office (Pest Vármegyei Kormányhivatal), or the government office competent for your place of residence.
- Conciliation board: based on the Service Provider's registered office, the Pest County Conciliation Board (Pest Vármegyei Békéltető Testület) (1055 Budapest, Balassi Bálint utca 25. IV/2.). The Service Provider is obliged to cooperate in conciliation board proceedings.
- Court proceedings: the Customer may also enforce their claim through civil court proceedings.
The Service Provider has not subscribed to the provisions of any code of conduct.
17. Intellectual property
All content appearing on the Website – in particular texts, photographs, graphics, illustrations, the SpicaHome logo and use of the name, and the appearance and design of the products – is the intellectual property of the Service Provider or its contractual partners and is protected by copyright.
Any use, reproduction, distribution, adaptation or communication to the public of any part of the content is permitted only with the Service Provider's prior written consent. Private, non-commercial use and quotation with acknowledgement of the source are exceptions to this.
Purchasing a limited-edition print means acquiring ownership of the physical copy of the work and does not give rise to any economic rights under copyright; reproduction of the work and its use for commercial purposes are not permitted.
An application to register the name SPICAHOME and the associated figurative mark as a trade mark is pending; the registration number will be shown here once the mark has been registered.
18. Data processing
The Service Provider processes personal data as set out in the privacy notice, in accordance with Regulation (EU) 2016/679 (GDPR).
19. Miscellaneous provisions
The Service Provider is not liable for delays caused by faults in the internet network, maintenance of the Website or force majeure, or for damage resulting from these.
Should any provision of the GTC prove to be invalid, this shall not affect the validity of the remaining provisions.
In matters not regulated in the GTC, the provisions of Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services, Government Decree 45/2014. (II. 26.) Korm. on the detailed rules of contracts between consumers and businesses, Government Decree 373/2021. (VI. 30.) Korm. on the detailed rules of contracts between consumers and businesses for the sale of goods, and Act CLV of 1997 on consumer protection shall apply.
